MANDATORY MERGER CONTROL ON ASSOCIATIVE AGREEMENTS: A NEW DECISION FROM CADE
The Brazilian competition authority (CADE) ruled, on the February 22 judgment session, a new decision on the controversial issue of associative agreements, which has been intensely debated since the current Brazilian Competition Law entered into force.
This article explores the paths taken by CADE’s case law, which has been consolidating more precise delimitations of the abstract terms brought in the completion regulation, especially on common ventures and actual cooperation to carry out an economic activity.
